The 105-Day Extended Maternity Leave Benefit:
The 105-Day Expanded Maternity Leave Law (RA 11210 or EML) provides the updated policy on maternity leave that cover females who are workers in the private and public sectors, workers in the informal economy, voluntary contributors to the Social Security System (SSS), and national athletes. It likewise grants a woman the option to allocate up to seven days of paid maternity leave to her child’s father or an alternate care giver.

Eligibility
- Female employees in the private sector, regardless of civil status or legitimacy of the child, are eligible for the 105-Day EML benefit.
- Pregnant employees must inform their employers of their pregnancy and the estimated date of childbirth.

Notice Requirement:
- Pregnant employees must give their employers at least 30 days' notice before the start of their maternity leave, unless the pregnancy or childbirth prevents them from doing so.

Leave Duration
- Female employees can avail of a total of 105 calendar days of maternity leave with pay.
- The maternity leave can be availed of either before or after childbirth.
- In cases of miscarriage or emergency termination of pregnancy, which includes still birth, the paid maternity leave shall be 60 days.
